Introduction

1.1 Definitions and Terms Used

  • Agentiz Company or Company or We — Agentiz Sp. z o.o. (Wroclaw, Poland; NIP 7010464928);
  • Agentiz Site or Site — the website hosted at https://www.agentiz.com and its affiliated regional websites, designed to operate in each country around the world with subdomains and separate domain names (full list), API, and derivative mobile applications;
  • User Agreement or Agreement — this User Agreement, which acts as a set of documents and serves as a Public Contract (Public Offer), regulating the use of the Site and relations between You and Agentiz Company;
  • Privacy and Data Use Policy or Data Use Policy — a document defining the terms of collection, processing, and use of your personal data;
  • Site Rules — a document regulating the use of the Site;
  • Services — functions of the Site and services based on them (in the form of complex combinations of functions or as standalone services), applications, technologies, and software solutions;
  • Visitor — a person using, viewing, visiting the Site without undergoing registration and authentication;
  • User — a Site visitor who has registered and uses the Site after authentication, i.e., after successfully logging in with their username and password;
  • Audience — the aggregate of Visitors and Users of the site;
  • Advertiser — a private or legal entity placing advertising information using the Site's services;
  • Listing — information in text and/or graphic form about goods and services;
  • Agentiz Account — an account that tracks all payments of a specific Site User and expenses for using its Services.

Agentiz's mission is to facilitate the finding and dissemination of information about buying, selling, and renting real estate worldwide, with special attention to local needs. By creating a marketplace, we offer a platform that brings local markets together with global opportunities, ensuring that every user finds the services and information here that meet their unique requirements.

  • For Advertisers and Users - displaying advertisements targeted at the Site's Audience;

For user convenience and compliance with legal requirements, we structure and adapt your real estate listings, ensuring they meet local standards and audience expectations. Your information will be presented on the Agentiz site in a standardized style and format.

Personalizing Your Platform Experience

We personalize your interaction with our platform, configuring it to display in your preferred language, considering your individual goals and settings. This facilitates navigation and ensures that the information you post is accessible and understandable to the Site's audience.

Connecting with the People and Companies You're Interested In

We simplify the connection with the people and companies you need while maintaining your privacy level. Your personal information will be displayed only to the extent that you choose to disclose it.

Market Research

We analyze market trends by tracking user listings to reflect current real estate prices and supply volumes. This allows our users to navigate current prices, forecast market trends, and strategically plan their actions.

Combating Harmful Behavior

We actively combat all forms of harmful behavior, ensuring user protection and data security on the site. Whether technical glitches, suspicious activity, or manipulative behavior, we respond quickly by removing unwanted content, restricting access, and cooperating with law enforcement if necessary.

We continuously improve Services based on user behavior analysis, feedback, wishes, and complaints. By assessing User activity—such as interaction with the interface and time spent on the site—we gain valuable data to optimize the operation of the Agentiz Site, making it more intuitive and convenient for our audience.

We provide access to Agentiz services worldwide, maintaining data in various locations, including regions outside your country of residence. The site's infrastructure is managed by our company and physically located on servers in data centers within the EU, operated by trusted telecommunications service providers.

1.4. Our Use of Your Personal Data

By using our site, you agree to the display of advertising tailored to your interests, with your personal data being used exclusively to personalize these ads. We do not sell or disclose your personal information to advertisers without your explicit consent. Advertisers may set target audiences, but they only receive aggregated data on the effectiveness of their ads from us, without access to your personal details. More detailed information is provided in the General Provisions section (below).

1.5. Additional Terms and Rules That May Apply to You

This Agreement includes documents that are integral parts of this Agreement and are conveniently located on separate publicly accessible pages:

  • Site Rules. This document describes the terms under which you can use the Site and interact with its Services;
  • Privacy and Data Use Policy. This document explains how we collect and use your personal data to determine which advertisements may be relevant to you and how the Site interacts with you;
  • Cookies and Other Data Storage Technologies. This document describes how you can change your privacy level regarding our use of your data at any time.

If there are discrepancies between this Agreement and any additional terms, the additional terms will take precedence in details where there are contradictions.

General Provisions

This Agreement is the official agreement between You and Agentiz Company, establishing the rules for using the site and its functions. Additional services not covered by this Agreement are governed by separate agreements. By agreeing to its terms, You act either on your behalf or on behalf of third parties who have authorized you to do so.

2.1. Agreement to the Terms

Use of the Agentiz site implies your full consent to the terms of the Agreement. If you do not agree, are unable to enter into contracts (for example, if you are under 18 years old), or if access to the site is restricted for you due to sanctions, including if you are a citizen of Russia, Syria, North Korea, or Iran, you must cease using the site.

2.2. Rights and Obligations of the Parties

We value your choice of our site and services and expect you to comply with the established rules. In return, we provide you with access to quality services. Violation of these rules may lead to the need to restrict your access or remove information, which is part of our efforts to maintain the reliability of the platform and prevent legal risks for Agentiz Company.

2.2.1. As a User, You are required to:

  • Strictly adhere to the provisions of this Agreement;
  • Publish only verified and truthful information, for example, specifying the exact characteristics of the property in advertisements and providing real contact details;
  • Possess lawful rights to post information, including owning the property or having official permission from the owner.

2.2.2. You do not have the right to:

  • Use the Site in countries where it is illegal or engage in actions that are prohibited by the laws of your country;
  • Engage in illegal, fraudulent, discriminatory actions, or actions that mislead on the Site;
  • Infringe on anyone's rights, including intellectual property rights;
  • Create more than one personal and one commercial account;
  • Share your password, let others access your account, or transfer it without Company's permission;
  • Use the Site after your account has been blocked for violations;
  • Use automated means to collect data without permission or attempt to access data unauthorized;
  • Upload viruses, malicious code, or take actions that cause disruptions and overloads to our products.

2.2.3. You grant us permission to:

By posting content (texts, hyperlinks, photographs, videos, and other files) on the Site, you give Agentiz Company the right to use it within the scope of the provided Services. This includes the right to store, modify, distribute, create derivative works, and publicly display your information without additional remuneration, restrictions (regardless of volumes, time, geographic location, methods, and purposes of such actions), without the need for separate agreements, notifications, and permissions from you. You also agree that we have the authority to determine which search engines may index your content.

2.2.3.1. Permissions related to deletion of information

You have the right to delete your data from our site individually or by deactivating your account, as described in the Site Rules. Before deleting an account, you can download a copy of your data. Once deleted, information becomes inaccessible to other users but may remain in our systems in the following cases:

  • Technical limitations delay deletion up to 90 days;
  • Information is used by other Users in accordance with the Agreement;
  • Your data may be temporarily retained to comply with laws, investigate violations, or upon authorities' requests. Deletion of information takes into account technical conditions and legal requirements, with data retention limited to the necessary period for these purposes.

Your permission for data storage remains valid until complete removal from our systems.

2.2.3.2. Permission to use your information and information about your actions in connection with advertising and competing content

You permit us to use your information, including name, profile photo, contact details, and Advertisements, along with advertising or other content on the Site, even if it competes with your interests, without any compensation payment.

2.2.3.3. Permissions related to our software you use

By using our Site and related software, you agree to the automatic downloading and installation of updates for this software when they become available.

Additional Provisions

3.1. Updating the Agreement

We regularly update the User Agreement to reflect changes in our service and legislation. You will be notified (e.g., by email or via messages on the Site) of any significant changes 30 days before they come into effect, except when immediate changes are required by law. Continuing to use the Site after these changes will be considered your acceptance of the updated Agreement. If the updates are unacceptable to you, you may close your account at any time.

3.2. Suspension or Termination of Account

We may temporarily suspend or permanently close your account for serious or repeated violations of our Agreements, copyright infringement, or legal requirements. In such cases, we will notify you when possible and provide information on ways to appeal, unless it threatens the security or operation of the Site. Deactivation of your account terminates the Agreement, but certain provisions, including 2.2.3.1., remain in effect.

3.3. Limits of Liability

We are only liable for direct damages caused by our deliberate misleading or gross negligence.

Any losses that were not foreseeable by both parties at the time of the Agreement, as well as those beyond the control of Agentiz, are not our responsibility.

3.4. Disputes

In case of disputes arising from this Agreement, we aim to avoid conflicts.

If you are a resident of the EU and a consumer, disputes may be resolved in your local court under local legislation. For all other cases, disputes are to be settled in a Polish court according to Polish law.

3.5. Partial Fulfillment of Obligations

The invalidity of individual provisions of this Agreement does not affect the entire document.

Our failure to require your performance of any provision does not mean we waive our right to enforce it in the future.

3.6. Transfer of Rights and Obligations

You must obtain our consent to transfer your rights and obligations under this Agreement to third parties.

This Agreement does not grant rights to third parties.

We may transfer our rights and obligations to another organization without your consent in case of merger, acquisition, sale of our assets, or by law.
